The Mediation process begins with the parties filling out a questionnaire independent of each other.
Prior to the first meeting the questionnaires are reviewed by the mediator to determine the areas of agreement and the areas of disagreement.
The complexity of the case will determine how many Mediation meetings will be required.
Some cases can be mediated in as few as two meetings while others may take more.
The mediation takes place in an office setting attended by the parties and the mediator.
The meeting times are flexible and can be evenings or weekends depending on the parties schedule.
At the initial meeting the mediator attempts to establish what we refer to as a "framework for settlement".
This framework establishes in general terms how the issues of the divorce will be resolved.
In any negotiation the devil is in the details and divorce mediation is no different.
At subsequent meetings the mediator "ratchets down" the details to ultimately arrive at full settlement.
Once settlement is achieved the parties are referred to a paralegal service to prepare the paperwork for filing with the court.
Upon filing and acceptance by the court the divorce process is complete.
